Mr Donald Trump the former President of the United States, is facing felony charges in Georgia. These new charges are in no way similar to the already existing 78 charges. There are already three separate cases filed against him around the nation.
The Grand Jury
The Grand jury in Fulton County has charged the former President and his Allies under the Racketeer Influenced And Corrupt Organisations Act (RICO).
Racketeer Influenced And Corrupt Organisations Act is a federal law of the United States that gives criminal penalties and a civil cause of action for activity carried out as a part of a criminal organization. This is the act that deals with organized crime in the United States.
The Grand jury that took place in Georgia listed 41 counts, out of which 13 were against the former President.
Charges Under The RICO
The charges under the RICO statute of Georgia are greater in scope than the federal law. In order to convince a jury of these charges, the prosecution had to prove the criminal activities, their terms, methods, and purposes of the accused.
This is why to prove the charges against Trump, they have to convince that he took part in these activities to overturn the 2020 presidential election results in Georgia.
Trump is not the only defendant charged under this statute. His allies, Rudy Giuliani, fake electors who signed an illegal electoral college vote have also been charged under this statute.
All Persons Involved
The indictment charges Donal Trump, Rudy Giuliani, John Eastman, Kenneth Chesebro, Mark Meadows, the White House Chief of staff for Trump, a former official of the Justice Department, and 11 others.
Along with these charges, claims of fraud and misconduct have also been made against the group.
As a response to these charges, Mr. Giuliani has stated that “the real criminals are the people who have brought this case forward directly and indirectly”.
